5. Payment and Fees
Fees for our Services will be outlined in the relevant proposal or SoW. Payment terms are typically net 15 days from the invoice date unless otherwise agreed in writing. We utilize Stripe for secure payment processing.
Late payments may incur interest charges at the maximum rate permitted by law. Ai Boutique reserves the right to suspend Services for overdue accounts.
6. Confidentiality
Both Ai Boutique and the client agree to maintain the confidentiality of any proprietary or sensitive information disclosed during the course of the engagement. This includes business strategies, technical data, client information, and project details. Confidentiality obligations shall survive the termination of any agreement.
7. Limitation of Liability
To the maximum extent permitted by law, Ai Boutique shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the services; (b) any unauthorised access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services.
Our total liability for any claim arising out of or relating to these Terms or the Services is limited to the amount paid by the client to Ai Boutique for the specific Service giving rise to the claim in the preceding twelve (12) months.
AI solutions are provided based on current technology and data. While we strive for accuracy and effectiveness, Ai Boutique does not guarantee specific outcomes or ROI, as results depend on various factors including client implementation and market conditions.
8. Disclaimer of Warranties
The website and Services are provided on an "AS IS" and "AS AVAILABLE" basis. Ai Boutique makes no representations or warranties of any kind, express or implied, as to the operation of the Services, or the information, content, materials, or products included therein. You expressly agree that your use of the Services is at your sole risk.
9. Termination
Either party may terminate an engagement or specific Service with written notice as outlined in the governing SoW. Ai Boutique reserves the right to suspend or terminate your access to the website or Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. Provisions related to intellectual property, confidentiality, limitation of liability, and disclaimers shall survive termination.
